I'm pretty sure that the model in question is S1 (otherwise nag or not he
couldn't record at all without a sub) but regardless I agree with the
assessment as to if it is "stealing" (stealing as defined by popular
consensus in this group) as the terms with which TiVo has enabled the
ability to record on an S1 without a sub includes the nags (as in, if you
don't want to pay us money, nags are your cost for using the gear).

That's fine. Go ahead, write yourself an OS (or heck, use Linux), create
and compile up some drivers and some code to run that unit you bought and
you'll be all set. You have all the tools you need to record local
channels.

What's that you say? You want to use TiVo's software? And you want to do
it without paying them for it? That doesn't seem right, does it?

It's a series 1 and works right now with no service, Manuel mode just time and channels and date

I beleave that was part of a Law suit where they had to make the units work with out service

if i can't find how to do it i can live with what it does because it still works
i'm going to try to upgrade the Hard Drive right now to a 300 gig

Yes, it was pointed out that it was an S1. I don't think the basic
service was the result of a lawsuit, that's just how they were. They
obviously rethought the policy for S2's but weren't going to renege on
it for previous owners. Think of it as ad-ware or nagware, you get free
functions by suffering through the nag screens ;-). They're probably
hoping that eventually they'll wear you down and get you to sign up
again. But, since you can get an S2 for $50 now, that's probably unlikely.

Actually yes, in this case, it is. The unit is a Series1 and TiVo's
own policy for those units was that the subscription is NOT required
to record things. You can use an S1 as a kind of basic time/channel
DVR without the service. The only annoyance is that it regularly nags
you about all the neat things you could do if you'd just subscribe.
